When Do I Need an LSRP?

In New Jersey, an LSRP is needed to conduct or oversee the remediation process if you:

  1.  Discharged a hazardous substance to the land or water of the State.
  2. Are the owner of a regulated UST that has a known or suspected discharge, or are closing the UST.
  3. Are subject to and have an ISRA triggering event.
  4. Own a property on which a discharge is identified.
  5. Have a previous NFA or RAO that has been invalidated.
  6. Are subject to an Order or Judgement or any other oversight document requiring remediation.
  7. Have a Remedial Action Permit.

  • Review New Jersey's Property Owner's Guide to Hiring a Licensed Site Remediation Professional. https://www.nj.gov/lsrpboard/board/licensure/lsrp_hiring_guide.pdf 
  • Make sure the LSRP provides a proposal and contract that demonstrates knowledge of your situation and the regulatory requirements that need to be fulfilled.
  • Screen potential LSRPs for experience and potential previous Board Violations, Disciplinary Actions,  and Settlements.
  • Consider Value as well as Price.

Costs for LSRP services from different providers can range quite a bit for seemingly similar work.  Factors influencing these costs are typically the LSRP's hourly rate, which often reflects the experience of the LSRP, and the amount of time it will take to provide the services.  The use of support staff and selection of subcontractors can also influence total costs in either direction.

When selecting an LSRP, consider additional factors including:

  • Expected outcomes of competing LSRPs.  
  • How much time the LSRP has spent to help you understand the requirements - the risks - what you must do - and what you are not required to do.
  • Activities that may provide additional value or reduce risks.
